Consequently, when the nurse is transferred to the position of a cleaner, her labor function will undergo serious changes. It is for this reason that it is necessary to obtain the written consent of the employee for the translation.

Feasibility of transferring an employee from the position of a medical orderly to the position of a cleaner

The plans of the government of the Russian Federation by 2018 - an increase in the average wage social workers medical institutions, junior and nursing or pharmaceutical personnel up to 100 percent of the average salary in a particular region.

This means that the salaries of middle and junior medical personnel will be approximately equal, or more precisely, the salary of junior medical workers will increase. This, in turn, will make it possible to complete staff position nurses.

However, this one way or another will lead to the fact that at some certain period of time, the salaries of the middle and junior medical personnel will be equal.

However, there is a problem, and, oddly enough, it sounds very commonplace for our state - health care facilities simply do not have the money to raise such wages.

This explains the desire of heads of medical organizations to save money on junior medical personnel.

In reality, there are two options for reducing the cost of wages of nursing staff:

  • outsourcing - conclusion of an agreement with an external contractor;
  • transfer of nurses to cleaners.

Outsourcing in reality, as a rule, does not pay for itself, so the administration of the health care facility prefers to focus on the first option.

As a rule, medical institutions are trying to save money on positions included in the salary-health form (order of Rosstat No. 581 of October 7, 2016). That is why the transfer to a non-medical position primarily concerns nurses.

What will change during translation

Requirements for translation: everything is in accordance with the law

The Ministry of Labor has established the following cleaning professions:

  • office cleaner;
  • cleaner of industrial premises.

Therefore, when transferring a nurse to the position of a cleaner, you need to choose one of the above names. However, it should be remembered that at present there is no position of "cleaner of office and industrial premises".

It is necessary to clearly explain to the employee why she needs to transfer to another position. This is very important, because without her written consent, the translation would be a violation (Articles 72, 72.1 Labor Code RF).

When making a transfer, it is necessary to conclude an additional agreement with the employee to the employment contract, which specifies all the conditions to be changed:

  1. The new name of the position.
  2. Obligations of the employee.
  3. New terms of remuneration.

An additional agreement signed by both parties is a mandatory component of the employment contract. It is it that confirms that the employee agrees to transfer to another position.

You can use another method, which is also within the scope of the law - termination of the employment contract in the event of a reduction in the staff or the number of personnel of a medical facility.

In other words, it is permissible to salt an employee if, even with his written consent, there is no possibility of transferring him to another position.

This applies to both vacant positions and positions corresponding to the qualifications of the employee, as well as vacant lower positions or lower-paid jobs that an employee can perform, taking into account the state of his health.

The employee should be offered all positions possible in the area. In addition, the employer is obliged to offer vacancies in other localities, if this is prescribed in the collective agreement or employment contract.

On this basis, it is possible to introduce new positions - a cleaner of industrial premises or a cleaner of office premises, and reduce the positions of nurses.

At the same time, nurses should be offered the positions of cleaning ladies. It should be borne in mind that when the positions of nurses are reduced, they can be offered the positions of not only cleaners, but also janitors, etc.

Another reason for the dismissal of a nurse is certification for compliance with the position held in accordance with the professional standard "Junior medical personnel", which provides for employees with secondary general education and vocational training for the position of "Nurse".

However, this professional standard was introduced recently, therefore, not a single nurse meets these requirements.

This means that according to the results of certification, the nurse can be dismissed due to the inadequacy of the position held due to insufficient qualifications, and offer her to take the position of a cleaner.

There is one more way to transfer nurses to cleaners - economic. Higher is set wage cleaning ladies, and the nurse is simply lured to this place. Further, the salary of a cleaning lady may not be indexed at such a rapid pace.

However, in this case, it becomes problematic to require the nurse to perform the previous work in full. The whole problem is that not all the duties of a nurse can be entrusted to a cleaner.

However, labor legislation does not prevent the job of a cleaner in industrial premises from being closer to that of a medical orderly. V labor contract additional provisions are included that do not worsen the position of the employee.

For most people, there is no difference, but for employees of medical institutions, the job title alone depends labor duties, wages and vacations. The reorganization of the institutions led to the fact that the hospital staff was divided into medical and technical, which led to staff reductions, confusion over authority and the transfer of staff to other positions. To understand the responsibilities of the staff of a medical institution, you first need to understand who is health worker, and who belongs to the other staff? Federal Law "On the Fundamentals of Health Protection of Citizens in Russian Federation"gives us the definition of a health worker: a health worker - individual who has a medical or other education, works in a medical organization and whose labor (official) duties include the implementation of medical activities, or an individual who is individual entrepreneur directly carrying out medical activities; The law also provides a definition of medical activity: medical activity - professional activity to provide medical care, carrying out medical examinations, medical examinations and medical examinations, sanitary and anti-epidemic (preventive) measures and professional activities related to the transplantation (transplantation) of organs and (or) tissues, circulation of donor blood and (or) its components for medical purposes; Whether these actions relate to the work of a cleaner or a nurse can be clarified from the documents: Order of the Ministry of Health of July 23, 2010 No. 541n and Resolution of the Ministry of Labor of November 10, 1992 N 31 (supplements the Order of the Ministry of Health and Social Development of the Russian Federation of October 24, 2005 N 648), from which it becomes it is clear: the nurse is a health worker, the cleaner is not. This follows from the responsibilities listed in the documents. Both the nurse and the cleaner are obliged to clean the premises, but the nurse performs the cleaning in the premises of the medical organization, while the cleaner - in the production or office premises. Then there are lines about the nature of the work, which accurately convey the place of activity - for the nurse: Assists the senior nurse in obtaining medicines, tools, equipment and delivering them to the department. Receives from the hostess sister and ensures the correct storage and use of linen, household utensils, dishes and detergents ... for the cleaning lady: Dust removal, sweeping and washing by hand or with the help of machines and fixtures of floors, stairs, staircases, windows, walls, ceilings in industrial premises ... Moreover, the cleaner does not carry out sanitary and anti-epidemic measures, but only performs sanitization of industrial premises, therefore, the powers of such an employee are outside of medical activities. Can a cleaning lady work in a medical facility? To implement such activities, one must bear in mind the qualification characteristics of workers by industry, for example, a cleaner of industrial premises, can work in industries or in workshops, that is, in places of continuous industrial works... SanPiN 2.2.4.548-96. 2.2.4 tells us which premises should be considered as production premises: Production premises are enclosed spaces in specially designed buildings and structures, in which constantly (in shifts) or periodically (during the working day) labor activity of people. The definition is vague, and does not give a specific description, so we turn to the definition from the Russian encyclopedia on labor protection: activity. According to their purpose, they are subdivided into production (main workshop enterprises), auxiliary production (for auxiliary production), energy (provision with compressed air, steam, electricity), storage facilities. Information about the availability of such premises should be checked with the administration of a particular medical institution, however, such premises are probably not: halls, corridors, lobbies. A cleaning lady of office premises is suitable for cleaning the aforementioned places; her duties include cleaning the halls, lobbies, stairwells, office and other premises of public and administrative buildings. Therefore, such an employee can engage in work activities on the territory of the institution, but only in strictly established places. And in the wards? Patient rooms do not belong to either production premises or service premises. Work in wards and departments involves the implementation of sanitary and epidemiological measures, and since the duties of any of the aforementioned cleaners include only hygiene and sanitation in industrial premises and serviced equipment, only nurses have the right to work in the wards.

Hello! The position can be renamed only with the consent of the employee, or according to the norms of Art. 74 of the Labor Code of the Russian Federation, according to which in the case when, for reasons related to changes in organizational or technological working conditions (changes in technology and production technology, structural reorganization of production, other reasons), the terms of the labor contract determined by the parties cannot be preserved, their change is allowed at the initiative of the employer, with the exception of changes in the employee's labor function. The employer is obliged to notify the employee in writing not later than two months in advance of the upcoming changes in the terms of the employment contract determined by the parties, as well as the reasons that caused the need for such changes, unless otherwise provided by this Code. If the employee does not agree to work under the new conditions, then the employer is obliged to offer him in writing another job available to the employer (as vacant post or work corresponding to the qualifications of the employee, and a vacant lower position or lower-paid work), which the employee can perform, taking into account his state of health. At the same time, the employer is obliged to offer the employee all the vacancies that meet the specified requirements that he has in the area. The employer is obliged to offer vacancies in other localities if it is provided for by the collective agreement, agreements, labor contract. With absence said work or the refusal of the employee from the offered work, the employment contract is terminated in accordance with paragraph 7 of the first part of Article 77 of this Code. In your situation, the labor function also changes and essential working conditions, and this already means a transfer to another job, which is not permissible without the consent of the employee.
