Where are OKVED codes used and why are they needed?

You can find OKVED codes in the following documents:

  • when filling out an application for registration of an individual entrepreneur or LLC, you must specify the codes economic activity to be handled by the organization. Moreover, there may be several codes (according to the law, the number of OKVED codes indicated is not limited), but it is imperative to indicate the main type of activity, indicating the appropriate code. The main type of activity affects the calculation of the amount of contributions paid to insurance and pension funds;
  • OKVED codes found in regulatory and legal documents related to the regulation of individual economic types activities;
  • in the state statistical register, which keeps records of activities and regulates the development of economic processes;
  • in other documents of the state and international level related to the maintenance of statistics and storage of information on types of economic activities.

In everyday life, an entrepreneur may encounter OKVED codes in the following situations:

  • when filling out an application for registration of an individual entrepreneur, LLC or organization of another legal form;
  • when filling out an application for changing the type of activity (adding or removing);
  • when developing the company's charter, OKVED codes must be indicated.

OKVED codes are presented in a hierarchical form with a gradual decoding of activities. The grouping code of economic activities consists of two to six digital characters. List structure: XX. - Class; XX.X - subclass; XX.XX - group; XX.XX.X - subgroup; XX.XX.XX - view.

The all-Russian classifier of types of economic activity is needed to systematize information about enterprises and individual entrepreneurs. The list of OKVED is the same for all organizations and individual entrepreneurs, does not depend on the taxation system, form of ownership and level of income.

With the help of OKVED:

  • statistical bodies collect and organize information about organizations and individual entrepreneurs;
  • tax authorities determine the procedure and amount of their taxation;
  • supervisory agencies legislatively regulate their activities.

Each type of activity in the classifier has its own code from 2 to 6 digits.

Since July 11, 2016, a new classifier has been in effect for individual entrepreneurs and enterprises - OKVED-2 (version OK 029-2014 (NACE Rev. 2)), approved by order of Rosstandart N 14-st of 01/31/2014. It consists of 21 sections. Each section defines a separate economic area.

Example: Section H - transport and storage.

The first two digits of the code are classes:

Class 50 in section H - water transport activities.

50.10 - activities of sea passenger transport.

The following are subgroups that further flesh out the activity:

50.10.1 - carriage of passengers by sea vessels of foreign navigation.

The last, sixth character defines the type:

50.10.11 - carriage of passengers by sea vessels of foreign navigation, obeying the schedule.

Codes of 4 or more characters can be selected and registered. It is better not to specify much, so that later there will be no problems if you slightly change or expand the direction of activity. In the above example, it is advisable to select the code 50.10, then the entrepreneur or company will be able to carry out the transportation of passengers on ships in coastal waters and in sea and on ferries, on schedule and without, etc. And you don't have to make changes to OKVED every time.

Selection of OKVED codes for individual entrepreneurs and LLCs in 2018

The OKVED code must be selected independently from the classifier when registering an individual entrepreneur or organization. It is necessary to define one main type of activity and additional ones - there can be any number of them. The main activity is considered that will bring more income. The activities prescribed in the Charter of the organization must correspond to the chosen type in OKVED.

Tip: Think about what else you can do in the future and immediately list these activities. This will save you a lot of hassle.

In theory, you can specify at least the entire list from the classifier as additional species, but keep in mind that:

  1. Some types of OKVED for individual entrepreneurs and organizations require licenses and permits. This does not mean that by specifying the code of the activity subject to licensing, you will have to issue this license immediately. Just keep in mind that until there is a license, you will not be able to start the corresponding work, even if you register OKVED.
  2. Annually, until April 15 of the next year, organizations confirm their main activity in the Social Insurance Fund. Based on the documents, the FSS establishes the rate for calculating contributions for injuries. If you do not confirm the main type of activity, then the FSS will take for the calculation that type from your list for which the rate is maximum. The tax calendar in the "My Business" service will not let you forget about the necessary events, but if you forget, it will remind you.

You can always add or shorten your list of activities. To do this, by a decision of the founders, they amend the Charter (if any), submit an application to the tax authority (form R14001 for organizations, form R24001 for individual entrepreneurs). Organizations pay a state fee of 800 rubles, individual entrepreneurs do not pay. This is necessary within 3 working days after the start of a new activity.

Sanctions for non-compliance of OKVED codes

Article 14.25 of the Administrative Code, Part 3, states a fine of 5,000 rubles for officials for late submission of information about an individual entrepreneur or organization to the registration authorities. There are no OKVED sanctions anywhere else, but this does not mean that you can relax and not indicate the codes. Problems may arise when switching to special taxation regimes, when offsetting VAT, and partners may decide not to contact you as an unreliable counterparty. In other words, it is better not to ignore the obligations stipulated by the law - it can go sideways at any moment.

Does the taxation system affect OKVED codes for LLCs and individual entrepreneurs?

It is impossible to clearly divide OKVED by taxation systems. It happens that one and the same code can be used for different taxation regimes, and some types of special regimes, on the contrary, cannot be dealt with. But you will definitely not be able to switch to the special mode if OKVED codes are not indicated in your registration documents. At the first acquaintance with OKVED 2, it may seem that the classifier is difficult to master: 21 sections, each of which contains sections, and then there are also subsections. How to choose OKVED codes for IP 2019 among this variety?

Firstly, you need to know that in the application for registration of an individual entrepreneur, codes are entered in at least four characters. Having decided on a four-digit code, the applicant automatically selects a set of codes that is included in this larger one. For example, by specifying code 45.20, the entrepreneur receives the right to operate under all codes included in this group, such as 45.20.1; 45.20.2; 45.20.3 etc. You can choose your OKVED codes using our , it is enough to enter into it a keyword, for example, "trade", and you will receive several dozen codes with a description of the activities of each code.

Secondly, in general, the types of activities in OKVED are arranged logically, therefore, an entrepreneur, as a rule, only needs to research the section of the Classifier that interests him. Third, the SP is not forced to choose a single code. The applicant can enter in the application for business registration as many OKVED codes as they see fit. How to add a type of activity for an individual entrepreneur

If over time the direction of the entrepreneur's business expands or changes dramatically, then it may become necessary to add a type of activity for the individual entrepreneur. This is quite simple to do. First you need to open the OKVED 2019 codes with decoding for individual entrepreneurs and choose the code that most closely matches the type of activity. Then you can start filling out an application for adding a new code in the form ... The OKVED codes added to USRIP are indicated on page 1 of sheet E.

If it is assumed that the new type of activity will bring the maximum income, then it is necessary to add it to clause 1.1. If the entrepreneur simply adds a new OKVED code, without making it the main one, then clause 1.2 is filled in. As with the initial registration of an individual entrepreneur, OKVED codes are indicated in at least a four-digit format.

When submitting through an intermediary, the completed application must be certified by a notary. The state duty for adding types of activities from the individual entrepreneur is not required, therefore, immediately after the notary, you can send a representative to the “native” IFTS. The option of mailing can also be considered, but in this case it is imperative to make an inventory of the attachment.

The same form 24001 is used in order to exclude the unnecessary OKVED code, but now in sheet E the entrepreneur should be interested in page 2, reserved for codes that are subject to exclusion from the USRIP.

With a personal visit to the IFTS, notary certification of Form 24001 is not required. Please note that in this case, the application is not signed in advance; the entrepreneur must sign in the presence of a tax inspector. Despite the fact that individual entrepreneurship is a fairly simple form of carrying out activities on the market of Russian entrepreneurship, there are some restrictions for it provided for by law.

A license is a document, a special permit issued by an authorized body to carry out a specific type of activity, subject to certain conditions. The license is obtained after registration of the individual entrepreneur.

For certain types of activities of the individual entrepreneur, it is required to obtain appropriate permission from the state authorities (for example, the Ministry of Emergency Situations, the Sanitary and Epidemiological Service, etc.).

However, there are types of activities that an individual entrepreneur cannot carry out in principle. These types of activities include:

  • alcohol production;
  • trade in arms and ammunition;
  • disposal of ammunition and their components;
  • development of aviation technology, etc.

OKVED codes for individual entrepreneurs

OKVED is the All-Russian Classifier of Economic Activities.

Now let's figure out which OKVED is relevant today.

Current OKVED (as of 2017-2018):

  • canceled OKVED OK 029-2001 (NACE rev. 1) of 06.11.2001;
  • canceled OKVED OK 029-2007 (NACE revision 1.1) of 22.11.2007;
  • OKVED OK 029-2014 (NACE rev. 2) is in force.

Where are the OKVED codes entered

When registering, the individual entrepreneur fills out an application form P21001. When filling out sheet "A" and enter information about the types of economic activity.

Don't know your rights?

If you are inclined towards this or that activity, but doubt that you will do it, it is better to include this code in the application. Since in the future, if you do this activity, the procedure for making changes will require additional time. And the implementation of activities without entering information about it in the registration documents is prohibited.

The legislation does not provide for any penalties for specifying "unnecessary" types of activities. If this activity is not subject to licensing, feel free to enter the OKVED code in the application and do not worry about anything.

Another small nuance: the first code that you enter in sheet "A" will be the main type of your economic activity. That is, the size of the insurance rate for social insurance will depend on it and the possibility of your business falling into the category of “preferential”, for which lower insurance premiums are charged, for example, for pension insurance.

Remember one more rule: the OKVED code must consist of 4 digits; but in the new application form, which has been applied from 06/04/2013, it is not necessary to write the decoding of the OKVED code.

OKVED code (retail trade)

OKVED has a section G, which is called “Wholesale and retail trade; repair of vehicles, motorcycles ".

In this case, we are interested in the group starting with code 47.1 and ending with 47.99. According to OKVED codes, retail trade includes:

  • Sale of unchanged or resale of new or used goods to the public for their use for personal consumption.
  • Retail trade through various types of agents.

Do NOT apply to retail:

  • Hire of various items.
  • Selling food / drinks that can be consumed locally, or selling them outside of catering facilities.
  • Sale of cars, motorcycles, spare parts for them.
  • Trade in ores, oil, grain, production equipment, etc.

Changes in the types of economic activities of individual entrepreneurs

If, when registering an individual entrepreneur, you did not include in the application the type of activity that you want to do now, then you should not be upset - you can always make changes to the registration documents.

Let's walk through the procedure for making changes step by step.

  1. We take the P24001 application form and fill in separate sheets, depending on the type of changes being made.
  2. Next, we choose the method of submitting the application: in person at the IFTS or the MFC, or by mail. If you decide to send by mail, then you need to flash and certify the application form P24001 with a notary; after which the documents are sent by registered mail with a list of attachments.

If you decide to take the application personally, then take your passport with you. The state duty for making changes is not charged.

  1. After an employee of the IFTS or MFC has accepted your documents, he must give you a receipt for the receipt of documents, which must include the date of delivery of the documents, the employee's signature and the seal.
  2. Within 5 working days after the submission of the application, your documents will be ready. You go to the department of the Inspectorate of the Federal Tax Service with a passport and a receipt for the delivery of documents.

You should receive the following documents in your hands:

  • EGRIP record sheet;
  • extract from EGRIP.

When choosing the type of economic activity, try to look into the future: it is better to add the “extra” code in the application when registering than to waste time on making the appropriate changes. But do not forget about those types of activities that are subject to licensing: in this case, you will not be able to carry out activities without obtaining the appropriate document.
