Work on weekends and non-working holidays is prohibited, except for the cases provided for by this Code. Employees are attracted to work on weekends and non-working holidays with their written consent if it is necessary to perform unforeseen work in advance, on the urgent execution of which the normal work of the organization as a whole or its individual structural divisions, an individual entrepreneur depends on. Involvement of workers on weekends and non-working holidays without their consent is allowed in the following cases: 1) to prevent a catastrophe, industrial accident or eliminate the consequences of a catastrophe, industrial accident or natural disaster; 2) to prevent accidents, destruction or damage to the property of the employer, state or municipal property; 3) to perform work, the need for which is due to the introduction of a state of emergency or martial law, as well as urgent work in emergency conditions, that is, in the event of a disaster or threat of disaster (fires, floods, famine, earthquakes, epidemics or epizootics) and in other cases, endangering the life or normal living conditions of the entire population or part of it. Involvement in work on weekends and non-working holidays of creative workers of the media, cinematographic organizations, television and video filming teams, theaters, theater and concert organizations, circuses and other persons involved in the creation and (or) performance (exhibition) of works, in in accordance with the lists of jobs, professions, positions of these workers, approved by the Government of the Russian Federation, taking into account the opinion of the Russian Trilateral Commission for the Regulation of Social and Labor Relations, it is allowed in the manner prescribed by the collective agreement, local regulatory act, labor contract. In other cases, involvement in work on weekends and non-working holidays is allowed with the written consent of the employee and taking into account the opinion of the elected body of the primary trade union organization. On non-working holidays, it is allowed to carry out work, the suspension of which is impossible due to production and technical conditions (continuously operating organizations), work caused by the need to service the population, as well as urgent repair and loading and unloading operations. Involvement in work on weekends and non-working holidays of disabled people, women with children under the age of three, is allowed only if it is not prohibited for them for health reasons in accordance with a medical certificate issued in the manner prescribed by federal laws and other regulatory legal acts of the Russian Federation. At the same time, disabled people, women with children under the age of three years, must be informed against signature of their right to refuse to work on a weekend or a non-working holiday. 3) to perform work, the need for which is due to the introduction of a state of emergency or martial law, as well as urgent work in emergency conditions, that is, in the event of a disaster or threat of disaster (fires, floods, famine, earthquakes, epidemics or epizootics) and in other cases, endangering the life or normal living conditions of the entire population or part of it.

Involvement in work on weekends and non-working holidays of creative workers of the media, cinematographic organizations, television and video filming teams, theaters, theater and concert organizations, circuses and other persons involved in the creation and (or) performance (exhibition) of works, in in accordance with the lists of jobs, professions, positions of these workers, approved by the Government of the Russian Federation, taking into account the opinion of the Russian Trilateral Commission for the Regulation of Social and Labor Relations, it is allowed in the manner prescribed by the collective agreement, local regulatory act, labor contract.

In other cases, involvement in work on weekends and non-working holidays is allowed with the written consent of the employee and taking into account the opinion of the elected body of the primary trade union organization.

On non-working holidays, it is allowed to carry out work, the suspension of which is impossible due to production and technical conditions (continuously operating organizations), work caused by the need to service the population, as well as urgent repair and loading and unloading operations.

Involvement in work on weekends and non-working holidays of disabled people, women with children under the age of three, is allowed only if it is not prohibited for them for health reasons in accordance with a medical certificate issued in the manner prescribed by federal laws and other regulatory legal acts of the Russian Federation. At the same time, disabled people, women with children under the age of three years, must be informed against signature of their right to refuse to work on a weekend or a non-working holiday.

Attracting employees to work on weekends and non-working holidays is carried out by written order of the employer.

Work on weekends and non-working holidays is prohibited, except for the cases provided for by this Code.


Employees are attracted to work on weekends and non-working holidays with their written consent if it is necessary to perform unforeseen work in advance, on the urgent execution of which the normal work of the organization as a whole or its individual structural divisions, an individual entrepreneur depends on.


Attracting employees to work on weekends and non-working holidays without their consent is allowed in the following cases:

Labor legislation presupposes the protection of workers' rights.

The right to rest is inherent in workers. That is why the first part of Art. 113 of the Labor Code of the Russian Federation states that it is prohibited to involve people in their legal area. But there are exceptions to any rule.

There are situations when a person's presence at work is simply necessary and he is torn away from legal rest, either with or without consent. In addition, there are categories of workers whose recruitment, even with goodwill, has a number of features.

Before talking about the possibility of calling a person to work with his consent, it is necessary to define the concept of “day off”. To call an employee to work on his legal weekend or holiday, you must first obtain his consent. It must be expressed in writing. People are called to work in order to maintain the normal functioning of the enterprise.

When is consent not required?

Turning to article 113 of the Labor Code with comments, it becomes clear that any person can be called to work, taking him away from legal rest, and without asking whether he agrees or not in the following cases:

  • the call will help prevent a disaster or emergency;
  • going to work will provide an opportunity to eliminate the results of a disaster or emergency at the enterprise;
  • the challenge will help preserve the property of the employer, the state and the municipality from damage or loss;
  • the call to work is due to the imposed state of emergency / martial law or the elimination of consequences (for example, natural disasters, epidemics, widespread famine, etc.).

That is, every person, with the exception of certain social categories, cannot refuse to go out to work if there are circumstances that threaten the life and activities of the population. This list has no exceptions - that is, it is not supplemented at the request of the management and not a single item can be deleted from it at the request of subordinates.

Features of attracting creative workers to work

Article 113 of the Labor Code of the Russian Federation provides an exhaustive list of workers whose professions are considered to be creativity:

  • media staff;
  • television (cinema, TV programs, video filming, etc.);
  • music;
  • theatrical performances;
  • circus performances;
  • writers;
  • artists;
  • etc. A complete list can be found in Government Decree 252 of April 28, 2007.

That is, these are people whose life is in one way or another connected with creativity. This includes writers, screenwriters, actors, and those who sing and those who write music. And also journalists, videographers, directors, etc. Not only those who perform on stage, but also those who provide performances from behind the scenes. Labor activity of this category of workers on weekends is contractual. More precisely, creative workers are determined by the provisions of the labor / collective agreement and / or regulations adopted at the employer's enterprise.

Features of attracting people with disabilities, women with children to work

In the Russian Federation, those under the age of three and people with disabilities have certain advantages over other categories of workers. They can be called to work only if there are no medical contraindications.

If a person's health condition does not allow him to go to work on the day of rest or there is no one to leave a young child with, he may simply refuse.

Moreover, the employer must notify his subordinates in writing about the possibility of refusal. The same guarantees are provided for parents raising children alone (children under five years of age and / or with disabilities) and people with dependent relatives who need constant care on the basis of a doctor's opinion. Among other things, it is strictly forbidden to recall pregnant women from home on a non-working day to perform work duties.

How to apply for employment?

In order to call a person to the workplace on weekends and at the same time not violate the Labor Code, taking into account the comments for 2017, everything must be properly documented. In addition, the subordinate must agree to work. And this must be done in writing.

Obtaining written consent from the employee

Why do you need such a document as the written consent of a subordinate that he has nothing against working at the time when he should rest. This document can be drawn up arbitrarily. However, some data are indicated in it without fail:

  • employee personal information;
  • position;
  • release date and time for which the employee will be involved;
  • responsibilities to be fulfilled / reason for recall.

A document is written in the name of the head of the enterprise and is registered in accordance with the accepted document flow. And this is necessary in order for the management to have a written confirmation of the subordinate's freedom of expression.

Employer's order

There must be an official document on the part of the management.

Namely, an order that a specific employee must be present at the workplace on a specific day. The legislation does not provide for a special form of such an order. It is written in free form, but with the obligatory indication of the following information:

  • personal data of the employee;
  • positions;
  • the date of departure and the time for which the employee will be involved;
  • responsibilities to be fulfilled / reasons for recall;
  • department in which the work will be performed.

The document is signed by the director. Also, a place is left so that the employee can leave his signature and a resolution that he is familiar with the order. A similar paper is written in two identical versions and handed out - one to the head, the second to the subordinate.

To avoid unnecessary paperwork, you can immediately register the possibility of a subordinate refusing to call on a non-working day. And add additional lines where he signs his consent or refusal. It is necessary to make a note on the time sheet if the subordinate agrees to work extra.

Work on holidays according to the schedule

It is allowed to involve employees working on non-working days / holidays without obtaining their written consent. A shift schedule means the performance of their work duties periodically. For example, two days after two, a day after three, etc. Payment in this case will be standard in accordance with the terms of the employment contract. Except for days officially recognized as non-working days in the country. These are days of all-Russian and / or international holidays. These include:

  • weekend on New Year's - the first five days;
  • Christmas Day - 7th in January;
  • Defenders of the Motherland Day (23.02) and Women's Day (8.03);
  • 01.05 - peace, labor, May;
  • May 9 (victory in the Second World War);
  • 06/12 - the day of our state;
  • National Unity Day - 04.11.

Work on these days must be paid, regardless of the double amount.

Work on weekends and non-working holidays is prohibited, except for the cases provided for by this Code.

Commentary on Article 113 of the Labor Code of the Russian Federation

1. Establishing a ban on attracting workers to work on weekends and non-working holidays, the commented article contains lists of circumstances that allow an employer to attract workers to work on such days, and regulates the procedure for attracting them to work.

2. The procedure for attracting workers to work on non-working days provided for by the commented article applies both to non-working days off and holidays established by federal law, and to weekends established by the collective agreement and internal labor regulations, shift schedules. The procedure for attracting employees to work on weekends and non-working holidays depends on the nature of the circumstances requiring the involvement of employees in such work.

3. In the event of the introduction of a state of emergency or martial law, the occurrence of a disaster or the threat of a disaster, in other cases that endanger the life or normal living conditions of the entire population or its part, and in other cases specified in part 3 of the commented article, the involvement of workers in work on weekends and non-working holidays is allowed without their consent. The list of such cases is exhaustive.

4. If it becomes necessary to carry out unforeseen work in advance, on the urgent implementation of which the further normal work of the organization or its structural divisions, an individual entrepreneur depends, employees may be involved in work on weekends and non-working holidays only with their written consent.

5. In other cases, in order to engage in work on weekends and public holidays, along with the written consent of the employee, the employer must also take into account the opinion of the elected body of the primary trade union organization (on the procedure for taking into account the opinion of the elected body of the primary trade union organization in cases where the employer's decision does not require a local of the normative act, see Articles 99, 371 of the Labor Code and a commentary to them).

6. Work in continuously operating organizations is carried out according to schedules and does not require adherence to the specified order. At the same time, these works should be fully covered by the guarantees provided to certain categories of workers (see paragraphs 7 and 8 of the commentary to this article).

7. It is prohibited to employ pregnant women and workers under the age of 18, with the exception of creative workers and professional athletes under the age of 18, types of work, professions whose positions are indicated in the relevant lists (see Art. Articles 259, 268, 348.8 of the Labor Code and a commentary to them).

8. Disabled people and women with children under the age of three may be involved in work on a day off or a non-working holiday only with their written consent and provided that such work is not prohibited for them for health reasons in accordance with a medical certificate. In relation to such employees, along with this procedure for recruiting to work on weekends and non-working holidays, an additional requirement must be observed: the employer is obliged to acquaint them, by signature, with the right to refuse to work on a weekend or a non-working holiday.

These guarantees also apply to mothers and fathers raising children under the age of five without a spouse; workers with disabled children; workers caring for sick members of their families in accordance with a medical certificate, and guardians (custodians) of minors (see Articles 259, 264 of the Labor Code and a commentary to them).

9. Work on weekends and non-working holidays is paid at least double. At the request of an employee who worked on a weekend or a non-working holiday, he may be given another day of rest. In this case, work on a non-working holiday is paid in a single amount, and the day of rest is not subject to payment (see article 153 of the Labor Code and the commentary to it).

Another commentary on Article 113 of the Labor Code of the Russian Federation

As a general rule, work on weekends and non-working holidays is prohibited. Employees may be involved in work on weekends and non-working holidays established for them only with their written consent and in cases established by law. Among such cases, Part 2 of Art. 113 refers to the need to perform unforeseen work in advance, on the urgent execution of which the normal work of the organization as a whole or its structural divisions or an individual entrepreneur depends in the future. These are, for example, urgent repair and loading and unloading operations, etc.

Part 3 of the commented article lists the cases when the attraction of workers to work on weekends and non-working holidays is allowed without their consent. The list of these cases is exhaustive.

Creative workers and professional athletes are involved in work on weekends and non-working holidays in accordance with the lists of jobs, professions, positions of these workers approved by the Government of the Russian Federation. In contrast to the previously existing procedure, at present, these lists should be established taking into account the opinion of the Russian Trilateral Commission for the Regulation of Social and Labor Relations.

So, for example, the Decree of the Government of the Russian Federation of 28.04.2007 N 252 approved the List of professions and positions of creative workers of the media, cinematography organizations, television and video filming teams, theaters, theater and concert organizations, circuses and other persons involved in the creation and ( or) the performance (exhibiting) of works, the specifics of the labor activity of which are established by the Labor Code of the Russian Federation.

The subject composition of this List fully corresponds to Part 4 of the commented article and covers artists of all genres; choreographers, conductors, sound technicians, cameramen, filmmakers, directors, stage directors, broadcasting and television directors, cameramen, choirmasters and their assistants; chief specialists in the areas of creative activity; editors and correspondents of publishing houses, editorial offices of newspapers or magazines; production artists; employees in the field of administrative and organizational activities; directors of film crews, their deputies, administrators, etc. (a total of 170 job titles).

Among the professions of workers there are props, costume designers, make-up artists, instrument tuners, illuminators, pyrotechnics, props, etc. (a total of 19 types of professions).

The legal basis for attracting them to work on weekends and non-working holidays is the specified List, as well as a collective agreement, a local regulatory act or an employment contract. Consequently, the procedure for attracting these entities to work on weekends and non-working holidays is established by acts adopted on the basis of an agreement between the parties.

In other cases, involvement in work on weekends and non-working holidays is allowed with the written consent of the employee and taking into account the opinion of the elected trade union body of this organization.

Part 6 of the commented article defines the main range of works, the production of which is allowed on non-working holidays. This circle includes work on the following grounds: the impossibility of suspension due to production and technical conditions, the need to service the population, as well as the urgency of repair and loading and unloading operations. It seems that the range of these works is of a restrictive nature and is not subject to broad interpretation.

Involvement of disabled persons, women with children under the age of three years, to work on weekends and non-working holidays is allowed, if such work is not prohibited for them for medical reasons. At the same time, these persons must be informed in writing of their right to refuse to work on weekends and non-working holidays (Article 113 of the Labor Code). It is prohibited to involve pregnant women in work on weekends and non-working holidays (Article 259 of the Labor Code) and employees under the age of 18 (Article 268 of the Labor Code).

Work on a weekend and a non-working holiday is paid at least double in accordance with the rules established by Art. 153 TC. At the request of the employee who worked on the specified day, he may be given another day of rest, and work in this case is paid in a single amount.

The remuneration of creative workers for work on weekends and non-working holidays can be determined on the basis of an employment contract, a collective agreement or a local regulatory act of the organization.

Temporary workers who have entered into an employment contract for up to two months (Article 290 of the Labor Code) may be involved in work on weekends and holidays.
