Article 42 project of the planning of the territory. Urban planning code of the Russian Federation

1. Preparation of planning projects of the territory is carried out to highlight the elements of the planning structure, to establish the boundaries of common areas, the boundaries of the zones of the planned location of capital construction objects, to determine the characteristics and priority of the planned development of the territory.

2. The site planning project consists of the main part, which is subject to approval, and materials for its justification.

3. The main part of the territory planning project includes:

1) a drawing or drawings of the layout of the territory, on which are displayed:

a) red lines. The procedure for establishing and displaying red lines denoting the boundaries of territories occupied by linear objects and (or) intended for the placement of linear objects is established by the federal executive body responsible for the development and implementation of state policy and legal regulation in the field of construction, architecture, urban planning ;

b) the boundaries of existing and planned elements of the planning structure;

c) the boundaries of the zones of the planned location of capital construction objects;

2) a provision on the characteristics of the planned development of the territory, including on the density and parameters of the development of the territory (within the limits established by the town planning regulations), on the characteristics of capital construction projects for residential, industrial, public and business and other purposes and necessary for the functioning of such facilities and provision the vital activity of citizens of objects of communal, transport, social infrastructure, including objects included in the programs for the integrated development of communal infrastructure systems, programs for the integrated development of transport infrastructure, programs for the integrated development of social infrastructure and necessary for the development of the territory within the boundaries of the element of the planning structure. For the zones of the planned location of objects of federal significance, objects of regional significance, objects of local significance, such a provision includes information on the density and parameters of the development of the territory necessary for the placement of these objects, as well as in order to agree on the project of planning the territory in accordance with Part 12.7 of Article 45 of this Code information on planned measures to ensure conservation in relation to the territorial zones in which the placement of these facilities is planned, the actual indicators of the provision of the territory with communal, transport, and social infrastructures and the actual indicators of the territorial availability of such facilities for the population;

3) provisions on the priority of the planned development of the territory, containing the stages of design, construction, reconstruction of capital construction objects of residential, industrial, public-business and other purposes and stages of construction, reconstruction of the objects of communal, transport, social infrastructures necessary for the functioning of such objects and ensuring the life of citizens , including objects included in the programs for the integrated development of communal infrastructure systems, the programs for the integrated development of transport infrastructure, the programs for the integrated development of social infrastructure.

4. Materials for the substantiation of the territory planning project contain:

1) a map (fragment of a map) of the planning structure of the territories of a settlement, an urban district, an inter-settlement territory of a municipal district with the display of the boundaries of the elements of the planning structure;

2) the results of engineering surveys in the amount provided for by the engineering survey program developed by the contractor, in cases where the performance of such engineering surveys for the preparation of documentation for the planning of the territory is required in accordance with this Code;

3) the rationale for determining the boundaries of the zones of the planned location of capital construction objects;

4) a scheme for organizing the movement of transport (including public transport) and pedestrians, reflecting the location of transport infrastructure facilities and taking into account the existing and forecast needs for transport provision on the territory, as well as a scheme for organizing the road network;

5) the scheme of the boundaries of the territories of cultural heritage objects;

6) a diagram of the boundaries of zones with special conditions for the use of the territory;

7) substantiation of the compliance of the planned parameters, the location and purpose of objects of regional significance, objects of local significance with the standards of urban planning and the requirements of urban planning regulations, as well as in relation to the territory within the boundaries of which it is envisaged to carry out activities for the integrated and sustainable development of the territory established by the rules of land use and development of the calculated indicators of the minimum permissible level of provision of the territory with facilities of communal, transport, social infrastructures and calculated indicators of the maximum permissible level of territorial accessibility of such facilities for the population;

8) a diagram showing the location of existing capital construction facilities, including linear facilities, facilities subject to demolition, construction in progress, as well as passages to public water bodies and their coastal strips;

9) options for planning and (or) volumetric-spatial solutions for the development of the territory in accordance with the project for the planning of the territory (in relation to the elements of the planning structure located in residential or public and business zones);

10) a list of measures to protect the territory from natural and man-made emergencies, including ensuring fire safety and civil defense;

11) a list of measures for environmental protection;

12) justification of the priority of the planned development of the territory;

13) the scheme of the vertical planning of the territory, engineering training and engineering protection of the territory, prepared in the cases established by the federal executive body authorized by the Government of the Russian Federation and in accordance with the requirements established by the federal executive body authorized by the Government of the Russian Federation;

14) other materials to substantiate the provisions for the planning of the territory.

5. The composition and content of territorial planning projects providing for the placement of one or several linear objects are established by the Government of the Russian Federation.

6. The composition of the territory planning project may include a traffic management project developed in accordance with the requirements of the Federal Law "On the organization of road traffic in the Russian Federation and on amendments to certain legislative acts of the Russian Federation".

2) provisions on the placement of capital construction objects of federal, regional or local significance, as well as on the characteristics of the planned development of the territory, including the density and parameters of the development of the territory and the characteristics of the development of systems of social, transport services and engineering and technical support necessary for the development of the territory.

4. Materials for the substantiation of the project for the planning of the territory include materials in graphic form and an explanatory note.

5. Materials for the justification of the project for the planning of the territory in graphical form contain:

1) the layout of the element of the planning structure;

2) the scheme of the use of the territory during the preparation of the project for the planning of the territory;

3) the scheme of the organization of the road network and the scheme of traffic in the relevant territory;

4) a diagram of the boundaries of the territories of cultural heritage objects;

5) a diagram of the boundaries of zones with special conditions for the use of territories;

6) the scheme of the vertical planning and engineering preparation of the territory;

7) other materials in graphic form to substantiate the provisions on the planning of the territory.

6. The explanatory note referred to in part 4 of this article contains a description and justification of the provisions concerning:

1) determining the parameters of the planned construction of systems of social, transport services and engineering and technical support necessary for the development of the territory;

2) protecting the territory from natural and man-made emergencies, carrying out civil defense and fire safety measures;

3) other issues of territory planning.

7. The composition and content of territorial planning projects, the preparation of which is carried out on the basis of territorial planning documents of the Russian Federation, are established by this Code and the regulatory legal acts of the Russian Federation adopted in accordance with it.

8. The composition and content of territorial planning projects, the preparation of which is carried out on the basis of territorial planning documents of the constituent entity of the Russian Federation, territorial planning documents of a municipal formation, are established by this Code, laws and other regulatory legal acts of the constituent entity of the Russian Federation.

    5. The composition and content of territorial planning projects providing for the placement of one or several linear objects are established by the Government of the Russian Federation.

    6. The composition of the territory planning project may include a traffic management project developed in accordance with the requirements of the Federal Law "On the organization of road traffic in the Russian Federation and on amendments to certain legislative acts of the Russian Federation".

Controls the balance of accounting for economic, environmental, social and other factors in the implementation of urban planning work. Proclaims the provision of appropriate conditions for persons with disabilities for their unhindered access to facilities for various purposes. Raises issues such as the participation of people and their associations in the implementation of urban planning, ensuring the freedom of such participation, the responsibility of the state authorities of our country, state authorities of the constituent entities of the Russian Federation and local self-government for ensuring decent living conditions for a person, etc.
